Driver charged in New Jersey Turnpike truck accident

A truck accident can occur for any number of reasons. It could happen because of drunk driving or distracted driving. It can also occur because a driver did not follow traffic laws. In those cases, a driver can easily be blamed, although a truck company can also be similarly liable. The recent truck accident that occurred on the New Jersey Turnpike which injured comedian Tracy Morgan illustrates not only the possible negligence of the truck driver, but also the possible negligence of the truck company.

The 45-year-old Morgan was traveling in a bus limousine together with colleagues and friends when their vehicle slowed down because of a previous accident. However, a Wal-Mart truck driven by a 35-year-old man supposedly veered off in order to avoid the slowing traffic. It then plowed right into the comedian's vehicle. Several passengers sustained serious injuries. Morgan was in critical condition after suffering several broken bones. Another comedian, James McNair, lost his life in the accident.

The truck driver was charged with death by auto and assault by auto. According to a criminal complaint filed against the driver, he allegedly had not slept for over 24 hours before the incident occurred. However, Wal-Mart stated that it believes that their driver complied with all federal safety policies. Nonetheless, a spokesperson for the company did not provide information on where the driver was headed or where he came from before the crash.

Although truck drivers can easily be blamed for a truck accident, a thorough investigation may indicate that a truck company or an employer may also be to blame. This is an essential piece of information for a New Jersey truck accident victim who is planning to file a personal injury lawsuit against a negligent party. Consulting with a legal advocate can also uncover other vital information that can help strengthen the legal action.
