Justice for the man who died in a pedestrian accident

Most people in New Jersey and elsewhere are aware of the importance of using pedestrian lanes and designated paths for crossing streets in order to avoid accidents. Sometimes, however, even the most cautious pedestrian is involved in an accident. Pedestrian accidents often turn tragic because of the high probability of injury or death to the pedestrian. The tragedy is significantly compounded when the injury or death results from a hit-and-run accident.

Last spring, a 51-year-old man from Pennsylvania died in a hit-and-run pedestrian accident. The incident happened around 1:30 a.m. when the victim and his girlfriend were crossing the street.

The man was pronounced dead at the scene of the accident. The driver fled the scene but headlight shards believed to belong to a GMC Envoy built between 2002 and 2009 were found at the scene. The police continue to search for the man responsible for the pedestrian's death. Unfortunately, they have almost no leads. No witnesses who actually saw the accident have come forward.

In cases, the immediate family members of the victims can file lawsuit against the negligent drivers. But if the driver cannot be found, there may be another option. If the victim had uninsured motorist coverage on his own automobile policy, that coverage will cover him for the damages that would have been recoverable from the unidentified driver. Under New Jersey and Pennsylvania law, uninsured motorist coverage covers a pedestrian who is hit by a driver without insurance. It also applies to hit-and-run drivers who have fled the scene and cannot be identified.
